After nearly 4 years of working in my present company in Bahrain, I'm planning to look for another company to seek professional and personal development. However, I have few queries regarding this career move. Hope you can help me with these queries.



  1. My VISA and CONTRACT are expiring by the end of August 2024. Am I entitled to have 1 month grade period to stay in Bahrain after August 2024 if ever I'm still looking for job that time?
  2. I'm worried about my company will cancel IMMEDIATELY my VISA if I submit notification letter to my company that I'm no longer renewing my contract.
  3. As per my contract regarding INDEMNITY PAY, I'm entitled at the rate of 15 days wage for each year of service ONLY upon termination of my employment. The /!\ I AM A STUPID SPAMMER /!\0 days is not mentioned on the 4th year of service onwards as per Bahrain LAW. I was not aware about the calculation of INDEMNITY PAY when I sign the contract because I'm just a fresher in Bahrain. My question is, do I have to claim the 30 days rate in my 4th year of service? What if the company impose what was written in the contract should still be followed?
  4. As per my contract regarding deduction when leaving the company, in case of resignation other expenses that paid by company like licenses shall be deducted to my last pay. Is it their right to deduct the license fee even if I finish the contract and not through resignation?

1) One month grace period after visa expiry or cancellation - has nothing to do with contract

2) Let them.  You will still have one month grace period

3) Forget all of this.  Nothing can be against labor law including indemnity.  You will get what is entitied as per labor law.  Read the link I posted

4) No they can't deduct anything unless you have accepted in writing that you will pay these fees if you resign and even then, labor court generally doesn't rule in favor of employer in these matters

@XTang thank you for your reply. thanks for all information in the link. Well noted on your response from 1 to 3.


For number 4, I signed the contract with clause stating about deduction of license fees paid by employer upon resignation. I would like to know if I can argue with them regarding this matter since I will not resign, only I will not renew my contract? Is resignation different from voluntary non renewal of contract?

For Bahrain, it is the same.  In Saudi it is treated differently as there, you have limited contracts for expats.

My employer renews my VISA in advance prior to its expiration in September.


I have further questions regarding this situation.


  1. If I leave the company in September, I don't have to pay for the visa renewal fees, am I right?
  2. If I stay in the company and signs new contract with new salary rate, then decided to leave after a month or two, what would be the implications of this situation?

UPDATE: I asked our HR for assessment of my salary increase. Unfortunately, it is not granted because the company business is not good. I understand the situation of the company, however I will proceed my initial plan which is to file my resignation.


I have few questions regarding resignation.


Which is ideal in this 2 scenarios?

  1. Upon filing resignation, I will be given one month notice period to turn over the duties. If I can't get new job offer from another company and one month is finished, my present employer will cancel my visa. Shall I get another one month notice period after cancellation of visa?
  2. Somebody told me that if I can't get new job offer and I finished the one month notice period to turn over of duties, they will cancel my visa the moment I leave Bahrain?


Lastly,

  1. Do I have to get police clearance if I will leave Bahrain for good?
  2. What are the things I need to do before leaving Bahrain?

If I plan to go to Dubai and look for job, do I have to tell my present employer about it or I would just tell them I'm going back to my home country?

@XTang I was able to access my details in SIO and I’m really disappointed to know that my salary details is not correct. I hope they still give me the right indemnity pay once I leave the company.

Hi,

A quick update.


The old rule was, if the visa is cancelled, you have 30 days to find a new employer or leave the country.


New rule is, If the visa wants to be cancelled, you have to leave the country first. Then the visa will be cancelled.


Once the visa is expired, and not renewed, you have 30 days to join a new company or leave the country.


Only way to work for a new employer is "mobility" or "resigning via postal" while your Visa is ACTIVE.


if you need to transfer to a new employer, ask mobility from current employer. Or resign through registered postal (make sure, you have 3+ months remaining validity in visa). Your new employer must apply visa 1 month prior to the resigning date from old employer.

Just a correction


Once the visa is expired, and not renewed, you have 30 days to join a new company or leave the country. - Once the visa is expired - No one can apply for the transfer or new visa. As of now NPRA issues extensions only at the airport in these cases and the employee has to exit at the same time NPRA is giving the extension.

Please note that not all laws are written everywhere. You can check LMRA - Instagram - Around 16 weeks ago - They have made the notification. But in terms, only HR will know the process, as they do it on a daily basis on the system.

To add, this applies to work permits, leading to a residence permit, issued by LMRA.  If you have a golden visa or any other type of visa issued by NPRA and a separate work permit, it doesn't apply to you.  You can get the work permit cancelled while remaining in the country.
