Laws changing for condo ownership and rentals?

Hello

I had a meeting with the owner of my condo. And she told me that they are changing the laws about ownership and rentals. She has two buildings and wants all of the owners to be in one building and the rental units in the other. Or, if I stay put the new law has to do with I need to rent out my condo with a contract for 3 or 6 months. Or, she could buy it from me. Give me what I paid for it as trade in toward one or her other properties. Not just give me the price outright.

I probably didn’t give a very good summation of our meeting. But has anyone heard of this or anything like it? The cynic in me tells me that this is just her gambit for trying to make some money. She would have guaranteed income for the contract.

SHE cannot own the building as that belongs to company that sells condo's to private owners under the 51/49 rules Thai/foreign

There are no rentals as far as she is concerned nor the company because condo's are always owned separately  (of course some can own more than 1 condo) and the respective owners can rent them out under their specific rules and regulations.

I think you are being taken for a ride

And since ownership of condo resorts under company regulations, I have not heard of that is this would be a HUGE problems for multinational companies in general

Yeah, I tend to think it's a line of crap she's feeding me. She also said she had a condo for sale that had been remodeled and I looked at the door and there's a westerners contact info. I'm sure she just wants in on it so she can get her 5% commission.

I think it is difficult to find honest people where there is a chance of money to be made in any way, shape or form... in any country and especially for foreigners in that country...

I have lived and worked in a few.....

Sorry but cannot understand.

How can she be the owner of your condo? Did you buy that unit or did you rent it from her?

Do you have the Chanote property act or not?

If it's registered at Land office under your name and you pay the yearly property tax, aswell the common area fee, means that it's regular unless you receive an official letter from the local Municipity.

She cannot decide where you should stay and live!

I think it is difficult to find honest people where there is a chance of money to be made in any way, shape or form... in any country and especially for foreigners in that country...

It's the same back in my country. Realtors were nearly always on

the slimy side. Had a friend who tried being a real estate agent and

quit because his boss was asking him to do things that were unethical.

I didn't word it very well she may be the manager I don't

know her exact title. The real question is were there any changes

to the laws. I don't believe there was I did a bit of research and

couldn't find anything. It was all pretty vague at our meeting

is why I haven't summarized it very well here. I should have got

better clarity from her

Have you checked if there is a committee? Normally, although not a legal requirement, condo's have that to make decisions on charges/fees etc. They must issue a ruling.

Even if she is the 'manager; she can not decide for you, get the owner of your condo involvded

As far as I know there have not been many changes about owning a condominium unit.

If you bought it and you got the Yellow property act (Chanote), which is written in Thai (also your name in Thai characters) then it belongs to you and they cannot ask you to leave like this, specially if nothing is written and just by words.

Maybe she is the juristic administration office manager that is in every condominium.

Wait and see, if she comes again tell her that you are the owner and no reason to leave, and ask her some written legislation document.

Thanks that's a helpful response. She didn't specifically ask me to leave

I think she is just being misleading and trying to earn more money but

not through ethical means. I am my unit owner there is no disputing that

she was trying to get me to sign a contract for the time I am out of Thailand

so she could rent my unit. She agreed to compensate me a consistent

amount for each month. 9000B I believe it was. Maybe for the low season

that would be in my favor. I never really considered renting out my unit in

part because all my stuff clothes, guitars etc is here.


I talked to reception and they thought she is the owner of the land but she

wasn't altogether sure. I also asked if there is a committee for decision

making and reception had not heard of this. It's rather difficult to talk to

other condo owners since nearly everyone uses their units for rental and

are not often here.


I think if I just stand pat nothing will come of it. If indeed the laws have

changed it could put her in something of a bind if she is getting pressure

from the gov. That could work in my favor. She did offer to use my condo as

a trade-in to a higher priced unit and her offer was decent. But I sensed no

urgency from her so that tells me she is not getting heat from the government.

That's now sounds completely different from your beginning explanation.

If she saw you not living all the time here, then to offer renting it when you not in Thailand, could have been a good proposal from her and act like an agent for you and keep it clean and have both a benefit. That's then your choice to consider or not.

And many foreigners often want to switch to a bigger unit and exchange it by sell and buy.

In fact she helped you by giving some ideas.

But Thai people when they explain in English are very direct and not able to give extensive explanations like western can do or expect from others and often can sound like tricky... But it's just a language limit.

There are some condos that are infact Condotels, you buy it as investment but make agreement that the juristic office use it as tourist guestroom and gives you a yearly % return based on the purchase price. She is trying to imitate that system for a benefit.

Not sure that it is so different than my original posting but anyway

It would be difficult to rent out my condo when I am gone since

all of my stuff is here such as clothes, guitars etc. She said she

can put them in her storage. Well, I looked at her storage area

and there isn't even a door it's and open area that anyone can

access. Just moving everything would be a hassle. I could put

it all in my car and that would be more secure. But still a hassle to

move everything.


If I have given any different information it is due to me looking into

things that have been suggested to me by this forum. I asked a

second receptionist about the group or committee of condo

owners and this one hadn't heard of it either.


Something else the manager wanted to do was remove my clothes

washer while my unit is rented. I asked her why and she said it

uses too much electricity. That gives you an idea of how tight she is.


i think it's pretty silly and there are better options such as taking the

extension cord out because there are not outlets in the bathroom

where the washer sits. Or, removing the hose from the water source to

the unit. I don't think anyone is going to try to replace either of these

things. Moving the washer many times makes it possible to get damaged

even if they are careful a wall could get bumped. Or It might get stolen from

the unsecure storage area she has. It's possible to make some money

from renting the unit but I think getting there isn't worth it.

Yes sure then not worth to move things, and never know if people that come are tidy.

Yes, would be more easy to disconnect electric and water to avoid use of washer, or to charge the units on the electric meter when check out, but this options looks to complicate for some Thais.

Anyway if you don't give to rent then all problems are solved, you close the door and you leave without hassle, and can find everything same when you get back.
