separated but not divorced

hi..my filipina friend is separated from her local husband..now she wants to remarry an american..does she still needs to be divorced from her local husband when their marriage is not registered in the phil.embassy and her status in the phils.is still single?..please advice..thanks..

Hi mamita123,

I have read your post with great interest. Please allow me to analyze the situation from a pure personal prospective.

Just looked up the definition of the word "Contract" and found out that its an agreement entered into voluntarily by two parties  with the intention of creating a legal obligation.

In my opinion, regardless whether the marriage has been registered in the phil. embassy or not its still an agreement/promise/contract between two parties and have to be terminated somehow (Divorce) so that your friend can remarry whoever she wants otherwise her second remarriage may become illegal.

Hope other members can make their statements as well in this regard.
