Laws regarding mobile phones/earpieces while riding a motorbike?

Hello,


Does anybody here know anything regarding traffic laws for using mobile phones while on motorbike? Is it illegal? How about a hands-free earpiece?


And how about using walkie-talkies while on the road? Is that illegal? Similarly, how about using an earpiece for the walkie-talkies while riding the motorbike?


Sorry for the variations of questions, but it is because I do need to know those specific sub-clauses, hehe...

The hand-free pieces are OK.  The rest?  They will pull you over and ticket you.

Oh really? It's weird, my boyfriend said he got pulled over for an earpiece! ... ?!?!

Some years ago, I did read in one the Vietnamese online Papers- the traffic laws are equally like those in the "western" world.
Applied and enforced  they are very differently by city and or province.

No more than 2 people on a motorbike is apparently only in Saigon enforced, whilst 5 drunk people in the darkness without light and helmet on a single motor bike or the drunk taxi driver, speeding well over 120 km/h in city limits not seem to be breaking the law.

As far, I did notice, driving almost daily, they have a task/job, a single one (checking helmets, ear peaces or for stolen bikes). If a control might be for ear peaces, any drunk or overloaded has a good chance to get away.

Just call it bad luck for your friend and get on with your life.

In almost 5 years, I have not been stopped ones and always, when in the bulk (here they here commonly stop like 500 or 1000 motorbikes at ones, 2-3 mini trucks and like 20-30 police) they always send  me away, without bakshish.

I remember driving on the freeway at night, I was pointed to pull over in a group of people. I didn't and kept driving. :rolleyes:

I would not recommend, neither would do. I have my paper work all around ok (assumption in best believe). If I get pulled over, ok - pay the fine (if any) and request a receipt :), whilst parallel doing my phone call.
Anything else will sort out without my doing.

Excellent advice! Might I just add: you may want to start to take down some details yourself on a notebook.

As discussed off-line with Wild_1: According to the latest traffic law 34/2010/NĐ-CP, section 9, paragraph 1, point e, it is forbidden "to operate a vehicle while using an umbrella, mobile phone, audio device/accessories..."

so it means that it is forbidden to use even hands-free piece in Vietnam.

The fine is 40.000 - 60.000 VND.

We are Viet Kieus, both speaking/reading fluently Vietnamese thus having access to the Vietnamese network/info sources that other foreigners don't have. I was born here in Saigon, lived here for nearly 20 years before leaving here many lifetimes ago.
