Hello everybody, my name is Hazel. I am new here. i am peruvian, living in Lima- Peru. My boyfriend came to peru with a tourist visa and now he is illegal. We are in love, i am pregnant, he wants to live with me here in Peru, we are married now, but we have a problem.
We went to Inmigraciones to change his status inmigrant visa. We went to apply for the resident visa, but they told us that he cant apply because his visa has expired.  They say that he has to travel to the border to apply for the visa again.. once the visa is valid, he can apply for the resident visa. To travel to Ecuador is not difficult for him, the problem is in Peruvian Embassy in Ecuador. They allow ecuatorian citizen and resident to apply for the peruvian visa, but They dont allow to people from another country to apply for the peruvian visa, they say he has to travel to his country and apply fo the peruvian  visa in his country. Do you know which country he can travel to apply for the peruvian visa?  Thanks for ur promt respond.

Hey lovebirds,

I usually don't give free legal advice but I'll make an exception for you. As he has a Nigerian passport, he will have to approach the Peruvian embassy in Nigeria for a new visa.
Another alternative is to approach the Nigerian embassy/consulate in Lima and claim political asylum in Peru stating that his life is in danger from political enemies in Nigeria and also mentioning that his fiancee, yourself, are pregnant with his child and that you and your child will require the presence of a partner and father to take care of yourselves.
Ask his family in Nigeria to book a criminal case against any known adversaries in his hometown and then send the documents to the Peruvian immigraciones in Lima. They should provide references of the investigating officers in Nigeria to support their claims.
This way, he can stay indefinitely in Peru once he is granted asylum. Later on, he can apply for a resident visa stating his case as an exceptional one.

Thanks for your reply, Nash. I am very happy to know that. I really appreciate your concern. Here in Peru there is no nigerian embassy, i saw that there is a nigerian embassy in brasil wich is in the corder of Peru..Do you this ca help? If he travel to  Brasil to  to state that his life  is in danger from political enemies?
i hope yes.  Thanks very much for your reply, Nash.

Great news! God bless.

I am ecstatic, you and your boyfriend take care. I am a specialist at extremely tricky cases like yours.

Great that I could be of help to you! Anything at all, leave me a message.

I love getting through immigration authorities and legal systems across the world, spent dogs' years now in that.

Get yourself a good life now! Cheerios.
