My old kafeel not paying my service award dues

Salam All.
I had been working for a company where i was  made redundant few years earlier. However I managed to find another job and after all the rigid legal procedure of naqal kafala (transfer of sponorship), I had changed my sponsor successfully in 2012. I was promised for my dues to be paid once the sponsorship had been transferred or if i had chose to take a final exit.

There was a significant amount of service award that had to be paid once i had transferred my sponsorship. However my old kafeel has been troubling me and not paying the dues since a long time now. Everytime I try to contact him or meet him he tries to ignore me. For this reason , I requested my former manager and colleagues to discuss the issue with the old kafeel but he still is trying to delay the issue and i have been to no avail.

I also tried to contact my country's embassy (pakistan embassy) for assistance in this regard but they claim that its too late now and as a result they will not be able to help. This has been the case since about 2 years now and I am still unable to recover the dues from him.

I would really appreciate genuine help and advice in this regard as I do not have much time. This is because I have also lost my second job now due to my employer claiming to be under pressure for hiring more Saudis. I am still unable to find a decent job since 4 months and my iqama will be due to expire in 2 months. For this reason i wanted to make sure that i can recover these dues prior to my iqama expires.

Hi..

If you have all the promises of payment made by your previous sponsor in written, then you can recover them in a legal way.. if nothing is written and signed, then you may as well forget it..

Because you are now not under his sponsorship, he is not responsible for the dues.. (Legally) - No Contract Exists !

Try speaking to him and discuss your situation.. He might as well have a good heart and settle down the matter..

i have the calculation from the company of the amount owed to me in respect of the dues, is that sufficient evidence to escalate the matter to legal proceedings?

This should be enough to get started.
Mind you a legal case will cost you few extra bucks and there wont a time limit for the verdict.

I advice you to get settle things out of the court as it will be much easier option. You may try to approach an "Influential Person" to speak with your old sponsor and get things done. Indeed 02 years is now an old case which makes legal proceedings even more slow.

If the calculations are officially on the company letter head or any other official document, then it stands good..

But the legal system here is too daunting.. Most of the times the sponsor does not show up.. when he does, then there are always excuses and sorts of thing which will make your life miserable..

I suggest.. try to speak to him as many times.. He is already bent towards not paying you.. If you approach legal way, he will then be hell bent..

As usual they all say "Khalli Walli".. I am sure he will also say the same !!
