Hi there,

My (Belgian) spouse and I married at the end of 2009, and I would like to know if it's possible to be "grandfathered" in on the laws that were in place until (I believe they changed in) 2013.

The new laws states that you have to have lived in Belgium for 5 years, regardless of how long you've been married.

Based on the old law (having been married to a Belgian for 3 years, regardless of where you live), I would be eligible to obtain citizenship. The websites I've looked at still give the old guidelines but, in having spoken with Belgian representatives from the embassy, this is no longer possible.

Any (legal) knowledge or advice would be greatly appreciated.

Thank you so much.

Hi Simon

unfortunatly you will have to follow the new procedure, meaning you would have to live 5 years in Belgium etc...

All applications after january 1st 2013, would have to follow the new procedure.

If you have any specific questions, you can send me a PM.

Good luck!
