Divorcing in Vietnam

Post new topic

Raggers

I know this is a little bit of topic but my friend, who happens to be a girl (I know they get treated with less respect, that's why i mention it) has been trying to settle for a divorce for over 1yr now because he had a child with another women whilst my friend was pregnant. Her husband has lots of money so I don't know what to suggest to her. I'm concerned for my friends well being because this man has stolen her property, is chasing her and among other things has said numerous threats to her (death, kidnap, etc.) I am worried about her and her child's safety and was wondering if anyone can help me.

Well, the Cong An is pretty useless UNLESS he commits a serious crime against her.

When children are involved, settlements get complicated PLUS there is a new law on divorce in effect as of 2015 January 01.

Best she see a lawyer.

Divorces anywhere in the world can get complicated and pretty ugly when they aren't consensual, and it sounds like this one certainly wouldn't be by mutual agreement.

While some members might, in fact, be lawyers or para-legals for the most part they won't be and asking for legal advice on a public forum is kind of like asking your electrician for advice on a medical problem.

Tell your friend to take Jaitch's very sound advice and seek out a local lawyer to advise her on her options. That's always the wisest thing to do.

(Funny how everywhere in the world, many people seem to hate lawyers until they actually need one.... then they love 'em! Never could figure that one out.)

Cheers,

Tell her get a digital recorder or hidden cameras , then save all his numerous threats. They will be valuable evidence when they meet at the court.

There is NO DIVORCE COURT PROCEEDINGS in VietNam - they are Tribunals which are substantially different.

Basically an adjudicator decides the matter which may be appealed to a Court.

Thank you for your help guys, its much appropriated. This woman in question has seen a lawyer (but her husband said he will pay them more to keep the marriage) and she has been to the court (but he said he will pay the court). Although I don't really know if this would work or if hes telling the truth I think maybe advising her to get another lawyer would be a good idea, or any other aid, but was wondering what you all think? Lost cause or not? Although I want the best interest I am advising her now, not strongly suggesting as the death threats have now turned on me (which I have logged)

No offense but I think she'd be better off getting advice from someone familiar with these types of situations. Taking advice from a foreigner, who gets his advice from an Expat.com, isn't the way to go. Tell her to find a good lawyer with connections, then, get out of the way.
