Work permit for foreigners in HCM city

Hello, my boyfriend and I are going to Ho Chi Minh city to open a restaurant. I have Vietnamese nationality and he has French. I am wondering if there are any of you in the same situation as us and could help us in the administrative procedures (enterprise creation with half capital from a Vietnamese and half from a European, does he have to get a work permit if he is one of the owner of the restaurant, how long would it take to have the residence permit, etc.) . I would really appreciate if you can share your experiences so that we can be prepared for this new adventure ;)

I have seen gone through Visa application webpage. For your case you need take business visa for your boyfriend....

thank you for your reply but we can't apply for a business visa in France, for that, we need to have had created the restaurant and to do that, we have to go to viet nam and find a location first and then start the company creation procedures, and for that, we need to do all that together in viet nam, I can't take the decisions all by myself.

   I am no expert in this field, so please don't take my advice without confirming it with an expert first; however, it seems logical to me that he could obtain a 90-day tourist visa to help you "do all of that first" and then apply for the business visa.

You should hire a Lawyer. That doesnt cost much money. They will give you good advice

i know he can get a 90 days tourist visa, that's what we're going to do. it's just in case the procedures may take longer than expected...

back when I was in Viet Nam, I already went to consult a lawyer and I can guarantee tou that the fees are very high!!! its in us dollar!! i think it was around a thousand of dollar for them to get you the work permit and the residence permit!

Again, I can't sware to it but, I think it is possible to get an extension on the 90 days if necessary - for a price, of course.

I'd recommend you go back to that lawyer, he is very cheap indeed (but make sure you get an investors or business license, you don't need residency)!

In any case, if your budget is small, I would get a 90 day multiple entry visa (which you can extend here), search for locations, extend visa if need be and once you're ready, go back to that lawyer.

If $1K will kill you or is way out of budget, I'd reconsider the business plan.

maybe for you $1K is not much but if you know how it would cost you if you do it all by yourself: it would cost you not even $50, its just that I wanted to keep that money to invest in my project (I'm going there to open a restaurant), so every single $ i can save would be better. in joining this blog, my objective is to find people who had been through this and would be kind to share their experience, not their judgement.

If you are a VN citizen and you marry him, according to a post recently he can get a 3 year TRC. Maybe its an easy way for you to get around things chealpy.

One thing you will find here is that the laws change monthly, hence the reason someone mentioned a lawyer as they are usually up to date with the changes in decrees.

Hi Thuy,

I am not expert. But first time you can use 3 months tourist visa. Then in hcm, you can search about establish a business requirement. When you have your joint stock company, automatically ur bf must apply business visa for a year and working permit. The required docs will be sponsored by your new company.
