The Energy Performance Certfication requirements - A petition has been successfully tabled but they now need speciifc examples of the FAILs
The correct implementation of Directive 2010/31/EU on the energy performance of buildings
and of Directive 2012/27/EU on energy efficiency have been subject to investigations by the
Commission in the course of 2015 and 2016. The correct implementation of these two
directives and sufficient enforcement of the energy efficiency EU policies have been amongst
the cornerstones of these investigations.
At present, the Commission services are in constant contact with the Maltese authorities,
which have proposed the introduction of specific legislative changes which aim at addressing
the remaining shortcomings of the national legal frameworks.
The Commission services would like to thank the petitioner for bringing this possible
shortcoming to the attention of the Commission, but would like to ask for more specific
information related to the case where a) an energy performance certificate for buildings or
building units which are constructed, sold or rented out to a new tenant were not issued and b)
access to actual billing and tariff information was denied and if a respective complaint has
been brought to the attention of the Malta Resource Authority and the Malta Resource
Authority has failed to take appropriate action.
If any additional information reveals that EU law is not being respected in Malta, the
Commission will consider contacting the Maltese authorities and further investigate the
specific case raised in the petition

It has to be said that its unlikely this has been rolled out very welll its sure hasnt been well publicised or pushed out and its even more likely that many people dont  even know about it

So be aware if asking formone onemust accept that the LL will be too happy at being questioned There is a very real fear of reprisals from Landlords, via abuse, house invasion when you are not home,locks changed, eviction, threats of violence etc and this usually prevents anyone from coming forward and reporting this tomthe EU commission

However I am relaibly informed that this has been pointed out in reply to the above petition= but luckily they have found a live real time example tosupport the fatcs thatbit isnt being acted upon.

It has also been confirmed by the Dept responsible for the Energy Performance Certification and Assessment that an EPC can be commissioned by the tenant and its cost can be deducted from the rent due

How that works in the real world and how legal that may be is not known - i only know one person who has done this and it did work and the LL has now got a nice new EPC for her property.

NEVER FORGET THAT THIS IS A LEGAL REQUIREMENT FOR ANY PROPERTY RENTED OR PURCHASED  AND HAS BEEN SINCE 2009

it is the responsibility of the owner of the property... .and is about €75 - ALL properties must have these by law since 2009 whether selling or renting
