Can an Employyer Enforce Unpaid Leave

Hi all,

Hope someone might know something about "unpaid leave" when working in bahrain.

My employer has threatened a couple of times in the past not paying people their salary calling it "unpaid leave" but never done it. This month however a number of people were told they would not be payed and must continue to work, while others have been told to stay home for the month and take "unpaid leave"....

I have searched in the labour law of bahrain and it doesn't really cover unpaid leave, apart from when you have used all your annual leave and/or sick leave and/or for an emergency.

My question is can companies legally do this??

Would appreciate any information you may have on this.

Simple answer, no.

They can choose to make you redundant and make the necessary payment but cannot keep you employed and not pay you salary - for leave to be valid, the employee has to apply for it.  Forced or garden leave is with pay.

So they can force you to take leave but it should be payed?

It's called garden leave and is put into place when there are disciplinary actions or you are being made redundant.
