Hi all,

I'm in the midst of changing employer. My last date is 20th of March, next Wednesday.

My stage 1 application was submitted 2 weeks but in KIV as my current EP was not cancelled physically. My current EP was already cancelled last Tuesday, 12th of March.

Am I allowed to stay in Malaysia if stage 1 application is approved or I will need an EP endorsement in order tp stay?

You can stay if you have Stage 1 approval before expiry date of shortened EP

Hi Gravitas,

As my information above, today my new employer informed as below:

"1.       While your EP application is still pending for approval, Special Pass is not required and you are allow to stay in the country until the stage 1 is approved for endorsement. We’ll monitor this closely and keep you posted.

2.       Once stage 1 is approved, you need to standby for passport submission once the application has been approved by Immigration (within 4 days) in order to avoid SP or overstay."

Is it correct as it's different from your information? I'm just worried since I don't want to be overstay.

As long as you have a valid EP you will not be overstaying. At the moment employer A presumably has not yet shortened their EP so everything is OK. Employer B is confirming a SP is not required because of your valid EP with Employer A

My EP is already shortened to 20th of March which is tomorrow. It means if there is no stage 1 approval tomorrow. I will be overstayed after that.

New employer is aware of my last date on the current EP. So it means their information is not correct that Special Pass is not required and I can stay while waiting for approval?

I don't think a new employer could apply for a SP anyway, only an existing employer late in applying for a renewal could cover the gap for one month using an SP.

Guess it's too late now to do anything about leaving. You don't say how long ago employer B gave that information.

Hi Gravitas,

They just informed me above information today. However, I'm not sure if it's correct. The application was in KIV2 weeks ago and last Tuesday, my EP was physically cancelled with last date 20th of March.

I kept following up with the new employer but no update about the approval yet. Today they only inform me above information that I can stay while waiting for stage 1 approval and SP is not required.
