How to calculate 14 days

Hi ,

if I leave Malaysia on 15th July and return to Malaysia on 21st July's morning, will it be counted as 5 days or 7 days (for calculating 14 days)?

or if i am leaving Malaysia at 12 midnight how they are gonna calculate.
Please help me with this

It's 5 days if you are in Malaysia for any time on 15th and 21st. It is a hypothetical question about midnight as it is just 1 minute and unlikely realife will end up that way. I would imagine the answer rests on where you were the previous or following midnights

Still I have a doubt on this.
How can I get the confirmation about how Malaysian government is going to calculate 14 days
Coz I have been to Bangkok last month 26 april left and came back on 1 may
And I am planning to go to my home town for a week 4 June to 12 June  ....I just need a confirmation before I book the ticket
And I have come to Malaysia on 12 th of January 2019
So 12 Jan to 12 June will complete my 6 month right?
Please advise ..I am totally confused

Go to your LHDN office and talk to a tax officer

Any holiday days outside Malaysia should be added to find qualifying date eg 12 days holiday  =182 +12=194th day

It's quite simple

You just need to be in Malaysia for 182 days out of the 365 days in the tax year 1st January to 31st December

Holidays are not counted as being in Malaysia

I just spoke with  LHDN custmer care
It's 6 days if you are in Malaysia for any time on 15th and 21st. they told they will counting 15th as well

Wasting your time really as the 14 day rule only applies if you are trying to link 2 tax years (which you are not)

All holidays in 2019 do is to increase the number of days until becoming tax resident for 2019.

Hahaha, I really don't believe what you were told over the phone as it doesn't represent the written rules. Answers depend how question is asked. The usual answer is "yes" So what did you ask?

You seem like an obsessive kind of person stuck in a narrow groove and wasting peoples time and your own.

ONCE AGAIN - You only arrived 12th January 2019 so tax year to be concerned with is only 2019 and the 14 day rule DOES NOT apply....ie IT IS NOT RELEVANT

i feel like you are pissed off answering my questions...........Sorry dear...
one of my friend who stay in Malaysia from long he told you can't go out of Malaysia for more than 14 days in consecutive 182 days ,so i was worried about that..
Just now i had a talk with tax officer she told we have to complete 182 days in current tax year and we can go out of country for more than 14 days also

The lady is correct. But the 182 days do not have to be consecutive (just a total)

After that you can be outside for any length of time.

14 day rule is only for linking tax years
