Hello,

I know that to obtain Maltese citizenship by marriage the couple needs to be married for at least 5 years. But my question is the following:

Does marriage give the right for temporary residence and working permit and if so, how is the procedure?

It's quite complex and much harder than say a EU nationals 3rd country spouse.

See for example https://www.maltatoday.com.mt/news/nati … ce_permits

Suggest you speak to a pro.

I am British but married a Maltese citizen some years prior to Malta joining the EU. Shortly after our marriage, my husband applied for "Freedom of Movement" for me which permitted me to live and work in Malta.

Checking the Maltese government website, it would appear this option is still available to foreign spouses of Maltese citizens. Perhaps if you check with Identity Malta this could be applicable in your case.

The supporting documents required to be presented at Evans Building in Valletta along with the application form can be found here;

Just a thought, but in the Malta Today newspaper article the Maltese person is referring to his non-EU partner.  Could it be they are not married?

A Freedom of Movement application requires the couple's marriage certificate confirming their marriage has been registered with the Maltese Public Registry.
