Iqama Transfer rules May 2020 ? Urgent query!

Would appreciate if anyone can share some insights on below case please:

Do you know if Manpower solution companies (recruitment agencies like Jaddarah, SMASCO etc) have different rules to follow as opposed to private companies for Naqal kafala. In my case i'm on sponsorship of one such company and working with Company ABC (example) and want to switch over to Company XYZ. However, as per my sponsor they can only release me over to current beneficiary (which is company ABC) and then i will have to initiate second transfer in order to join company XYZ.

My current beneficiary company (company ABC) doesn't have any objection for my move but we both are looking for simple solution (that would be to get a direct release from my sponsor - a manpower solution company). Do you know if they are right in their explanation for being unable to give me a direct release to company XYZ because they're citing labour office rules in this regard.


P.S. HR Ministry announced some relaxations to the rules but i'm not sure if these changes apply to Manpower companies too or if it's only for private companies. https://saudigazette.com.sa/article/591255

Local transfer of sponsorship is not a legal right of foreign expat worker. It is subject to the discretion of the sponsor and approval of the official MOL/MOI authority.

What are the requirements and procedure for the change of sponsor?

The act of transferring sponsorship of workers is sanctioned by the Ministry of Labor. Under current rules, a worker can only transfer to other sponsor/employer after having worked with his current employer for at least two years.

The first thing that the worker should do is to secure the consent and approval of his sponsor to transfer to another employer.

The procedure then is for his prospective sponsor to write a letter expressing his interest in the worker’s service and requesting for his release. If the conditions are so acceptable to the present sponsor, he should formally consent thereto and sign the release papers.

Thereafter, the prospective sponsor should present these documents with the application for transfer of sponsorship and iqama for official approval of the Ministry.

Unless the legal rules and procedures are followed, an employer may not allow his worker to work for others and a worker may not work for another employer.

Similarly, an employer may not employ workers of other employers. An employer may not allow a worker to work for his own account and a worker may not work for his own account. (Art. 39 SLL).

There is a probation period of 3 months.. Can't we leave within these 3 months and transfer to another kafeel??

Please help i got my transfer 2 months back but could not adjust hence i want to join another company but even after approval of my transfer by old employer my iqama transfer request was rejected after few days by ministry of interior.. Actually new kafeel didn't submit fee for 2 weeks.. Is it due to this non submission of iqama transfer fee for 2 weeks that my application has been rejected by MOI or some other problem??.. How to fix this??
