Termination of employment contract before start date

Post new topic

KaiserWilhelmII

Hello

I am working for company X through a singe-permit.
I had applied for a job at company Y, got accepted, signed the contract and also obtained the authorization for work permit for company Y from January 2021.

However, due to some disagreements, I will not be starting at company Y on the scheduled date of the contract. This is being discussed with company Y. I might start on another date or I may never start for that company.

If we do not come to an agreement, it is possible that I will not work for company Y. The work-contract from company Y says that notice periods are in accordance with " 3 JUILLET 1978. - Loi relative aux contrats de travail "

Could someone shed some light on how to cancel a contract before the start-date?
Should I send a registered post stating that I wish to terminate the contract?

Thanks

Edigj

I as far as I know there is no penalty for you doing so. I recommend sending them your resignation via email because it gives them time to find somebody else. Sent them asap  an email to HR and manage. Also sent them a registered post as well to make sure you have some proof.
