Stay in Netherlands work in Belgium

Post new topic

Hi,
Hope you can help answer my query.

I am currently staying in the Netherlands and have an ICT work permit. I've got a job in Belgium and will be moving there in a couple of months. My future employer has already applied for a Belgium work permit.

Question - Since my ICT work permit will expire on the last day of my employment at my current employer, will I be allowed to work in the Netherlands for a brief amount of time (2-3 weeks) before I move to Belgium?
Considering that I already have the Belgium work permit ready, do I have to immediately move from the Netherlands to Belgium?

Thank you for answering my queries.

Hi and welcome to the Forum.

Unless you're up to something that is detrimental to Dutch society, I suspect that the Dutch Government won't even know that you've done.  Possession of a Belgian residence permit does not automatically force you to move.

EU residents already have the facility for cross-border workers, so there is nothing illegal about living in 1 EU country while working in another.  Officially, you must de-register at the Gemeente in the Netherlands when you physically move, not the day you change jobs.  When you de-register at the Gemeente, you also lose your Dutch residence permit, so you don't need to notify the IND.

I suspect that if you ask someone in the Gemeente, you may well get a different answer depending on who you ask.  My advice is to just do it and not to try and do anything "official" in the 2-3 weeks.

Hope this helps.

Hi Cynic,

Thank you for your answer. That's was really helpful.

If I de-register at the Gemeente after getting my Belgium visa, is it fine to still stay in the Netherlands for a few weeks before moving to Belgium.
I'm only asking because my job end here in the Netherlands in the mid of the month and I will have to stay till the end of the month and then move to Belgium.
Or should I only deregister on the last day of my stay in Netherlands.
Would there be any constraints?

Thank you

Hi again.

I would describe the 2 weeks as the period you are moving your household from one place to another.  Personally, I would de-register on the very last day, if you do it earlier, you vanish from the Dutch national computer and things like going to see a doctor may become problematic.

Nobody is going to come knocking on your door on the last day of work to make sure you have left.
