Dependent RP renewal and travel

Hello All,

I am currently working in Belgium with visa type D. My RP is valid till 11th June 2022.

Due to some family emergency my wife had to travel back to India in last March.
Her RP expired on 10th June 2021, but dependent visa D is valid till 12th Dec 2021. She is currently in India.Can she travel to Belgium from India based upon visa D multi entry validity ?

After reaching Belgium can RP be renewed after a gap of 6 months?

Please suggest.

Hello,

it depends if she states to your commune that she was going abroad for more than 2 months or not.

You/she should call/send an email to the embassy.

The visa should still be valid, but you can expect her to have some big issue with the immigration police at the border.

I think that the embassy will ask her to request a "return visa".

Hello!

Me and my spouse had applied for RP renewal (application was filed by my employer) , after a long wait while I have received my single permit last week (Flanders region), there is no update/information on the renewal status for my spouse. She received Annex-15 on Oct 7 upon request (as the RP expired end of September) . Local commune informed that the file was sent to Brussels office on Oct 7
Is there a way to track/know the status.

no, it's an internal process.
The commune is your point of contact and they'll get in touch with you when the immigration will have decided what to do.

Would it be a correct assumption that ideally before the expiry of annex15 the commune should receive response from the Immigration . If not, then do we again request for extension/re-issue of annex15.
Also , is there a maximum number of days by when absolutely a decision must be made after which it is auto approved (like 120 days for Single Permit)

There might be, I'm not really aware of it.

But basically if you're working, it takes a little bit less than a month for the full process of renewal.
(And that's why you've to renew your RP 1 month before the card expire)

So they'll validate yours first as you're working, then the dependent one.

My annexe 15 mentions till February 20, 2022. It was issued November 22.

But Alex,. I have a question, my visa is valid till March 2022. Can I travel out of Belgium after the residence check by police? Or is it better I wait to collect my card A? I am thinking of collecting the Card A when I return from the holidays, am not just sure if it's advisable.

If you've a valid visa D (a multiple entry one I guess), then you don't really mind.
You should also be prepared to show the documents from the commune that your RP is under renewal if it's an international trip.
If it's within EU, well... no one will care as long as your visa is ok.

Now if you want to avoid any problem or questions at the borders, just wait for the A card.

Ok, great. I will wait for the A card.

I also want to ask after receiving an A card, what is the earliest time one can change an address? That is change apartments?

This is because, when I applied for the A card. I was in a hostel, now I have a suitable appartement for my family not sure when to move from the hostel to the apartment after the A card is issued

you must change your address within the 3 months of your move if I remember well.
You can do it immediately after you and the landlord have signed the lease contract + police check.

They just change it in the register of the foreigner at the commune + in the ship of your resident permit.
You always keep the resident card until it expires/canceled/lost/...

so the police is also going check me in the new apartment in the new commune after I inform the commune of my presence?

Cos police already checked me in the hostel.

yep, they always verify the address, and only after that it will be change at the foreigner register at the commune.
