KHURRAM SHAIKH

There should be some link file.bahrain.bh open it and get the details there you will find through which police station complained filed then contact police station for more details.

Filed means that a case has been registered against you.  It means that it is active.  Family courts usually are cases of divorce, spousal support etc.   Ask a lawyer to check on your behalf.   Or go to bahrain.bh and look through court cases - this is in Arabic only.

There is a case filed on you

Please I wish to find out i filed a case at the police station against my sponsor who is illegally keeping my passport.  The sponsor sent me a message to go and withdraw the case I filed against him and sign some documents.  I refused I told him if I don't have my passport in hand I will proceed with the complaint. He told me he doesn't care because he is out of bahrain in saudi Arabia.  So I contacted my lawyer about his messages my lawyer said if he does not return my passport the case is heading to public prosecution.

My worry is since he says he doesn't care and is un saudi arabia will he avoid the complaint or case and not  return my passport.  Or will the public prosecutor proceed the case without one of the parties.  Thank you

shakboomboom

He cannot avoid the case. It will still progress even in his absence. Sooner or later he WILL have to come to Bahrain. No matter what pressure he tries to put you in, DO NOT sign any documents. For now you are well placed.

XTang

Public prosecution can proceed with case regardless. And he will eventually come back to Bahrain. Don't sign anything and don't withdraw case.

@shakboomboom  thank you very much.  I feel relieved

nadinewhite010

@XTang thank you very much Sir

Holding on to the passport is a legal offense. You are on the right track and follow the instructions laid down by your Lawyer, you can also seek support from LMRA or your embassy.

All the best.

@Amd22  good morning sir. Thank you for your response.  Last week I checked with my lawyer and he said my case has been forwarded to public prosecution already because he the man in possession of my passport did not return it. My worry is can he try to leave the country for good and not answer to the case. Because already he is not making any effort to give back my document. He is indian nationality.  Also I wish to find out if I can take for damages because its five months now he has my passport. I don't work, have financial challenges and more. Thabk you for your response in advance

nadinewhite010

@Amd22 also I wrote to my embassy in saudi arabia because we don't have a consulate her nor embassy.  My worry if If he tries to leave bahrain or if the complaint can prevent him for leaving.   Because he told a few people he will not return the passport and I can do nothing to him. For all this time I lost and opportunities,  I wish to file for compensation but I don't know mu chances also

Amd22

@nadinewhite010 Hi Nadine, in most cases he shouldnt be able to leave the country as you have already filed a case against him.

What did your lawyer advise you? You can also ask for compensation for this period. Please pick this up with your lawyer.

XTang

You need to check.  Just filing a case in public prosecution doesn't lead to a travel ban.   That requires a judgement in your favor and even then, in some cases, you have to get it through an execution court.

nadinewhite010

@XTang thank you Sir for always dedicating your time to guide us expats on legal abd other issues..

Please Sur, I would like to find out do I need to be aware of information concerning my case aside of my case number. Still I don't have my case number. I paid my lawyer a visit but he was on Eid vacation he told me he will give me when he comes back. Reason I was wondering should I know my cased number only or more information in relation to my case. Also the person in possession on my passport send me threatening messages which I forwarded to my lawyer and he sent to the police.  My lawyer is Egyptian and I was told on bahraini lawyer go to court, was told my case will move from public prosecution to court. How will he represent me when he is not a bahraini.... thank you for your response in advance Sir.

nadinewhite010

@Amd22 thank you Sir got your advice.  I checked with my lawyer he is out of the country he said he will update me more when he comes back.

nadinewhite010

@XTang sir please I have a second preoccupation my friend visa is expired and she wishes to pay her overstay and move to UAE is that possible or she has to return to her home country first before moving to another country.  Thank you!
