application for a type D visa with a C visa

my husband had an agreement with a company and he has just received his work permit in Belgium .Now , and he is  just waiting for the 46  annex and then the D visa .

my husband and me , we are currently on Belgian territory for a period of 3 months with a C-visa (90 days) 

my question is : when he receives annex 46 (visa C still valid) do we have to return to Algeria to apply for a new  visa (visa D) or is there a possibility to do that in Belgium at the level of the ' immigration Office or other departments... as we are still on Belgian and our visa is valid. so as not to redo the whole procedure.

You have to return to  your home country and make a new procedure for D visa.

and if we have an impediment to go to my country now , like I am pregnant and I can't take the plane ! they don't take this situation as a particular case!? thank you for your reply

Airline policy is normally 8 months right?

Only as from 7months pregnant are you not allowed to fly and you must have the medical report ( scan) showing that you are 7 months pregnant hence, it's not advisable.

 I'm already at 31 weeks pregnant. (Beginning of the 8month )
so I'm lost I can't make a decision..

You can't fly from Belgium.

Get a doc from the obstetrician and take to the commune.

I don't think the Belgium immigration policy will force an 8month pregnant woman into a flight.

I sent an email to the immigration Office and also to the municipal service (municipal immigration office), I don't know how long they take to answer me !??

Why does immigration request documents that were already submitted ? We even have the checklist from TLS that proves the insurance was submitted.

For municipal office, it's better to book appointment to see them and speak with them one-on-one.

@Kendy Makere ok reply TLS that why are they demanding docs you already submitted; at the same time, prepare another copy of the insurance and DHL to them as soon as possible.

I believe sending them the docs they require will make them hasten up in taking a decision.

Let's hope for the best. It's all we can do in this waiting situation.

I sent them all my papers as well as the document issued by the doctor.

Another question :
Should i to let them know on the day of the appointment that my husband is awaiting for the annex 46. Or it will affect our request for an extension .

I think you should inform them and include that you have no one to help you other than your husband incase of an emergency during your child birth.

They are humans and I believe they will understand. You need your husband during your child birth. The commune and immigration will understand that.

After childbirth, there's also a duration during which your baby cannot be evacuated but you have to again get that document from the Paediatric, send it to the commune and immigration. Based on the document from the paediatric, the immigration will then inform you when you and your baby must leave.

But take note that it's complicated for your husband to try to change visa C to visa D from Belgium because the documents required for visa C is different from Visa D. For example you are not required to submit a doctor's Certificate of health and Police Certificate for Visa C. But fir a Visa D (Long Stay) you need these two docs to be verified by TLC or VSF and I don't think Brussels immigration wants to do this job of verification that's why we say converting from Visa C to Visa D while you are already in Belgium is complicated.

I hope they will allow me to extend the visa. you don't know how many months they will add to me on the visa please !

For the medical certificate and the police certificate. my husband filed them with the work file before he got the WP.

Since your husband already filed those when applying for the work permit, then let's hope for the best.
