PreNuptial UK - Morocco

asalaam alaikum

good evening to all


i'm looking for some advice on setting up a prenuptial.

i'm a UK national and soon to marry a Moroccan national.

i'm looking for advice on the following:


  1. how do i set up the prenuptial?
  2. do i need to set it up in the UK or Morocco?
  3. we intend on living in the UK. will marry in Morocco and she will join me after marriage in the UK

I believe best person to ask in this matter is an attorney/solicitor in the UK.  Moroccan lawyers from what I hear my not be 100% reliable all the time ( your answer would depend on how good and ethical your lawyer is).

Marriage will be recognized anywhere in the world. But I would think since you are living in the UK a prenup done in UK would protect you more as any divorce would be done in the country of residency no matter what country you were married in.

@SamDC thank you brother. that's good advice. i will be setting up the prenup in the UK, but my lawyer informs me that under normal circumstances, both parties would need to get individual legal advice about the prenup. and subsequently, the prenup will need to be signed in the lawyers presence. in my circumstances, with my fiance being in Morocco, what is the best thing to do?

@MrT786 As advised above if you are both planning to stay in the UK after marriage you can make the prenuptial agreement in the UK together when she arrives. You should consult with a lawyer in the UK for more information about this.


When you get married in Morocco. After the court has issued the approval to marry you will go to the office of the adoul to sign the marriage contract. The adoul will ask you both if you have any conditions for the marriage. This is where you both can tell him anything you want putting into the marriage contract, the same kind of conditions as a prenuptial agreement in case of divorce or other reasons. You can be as detailed as you need to be.


Please note though the conditions will be written in Aracic in the marriage contract so I suggest before going to the adoul you have these prepared in Arabic on a piece of paper that you will give to the adoul at the time of him writing the marriage contract.


You should also advise your adoul you intend to do this in the first meeting when you submit your documents to them for marriage.

i am arranging a meeting with my lawyer shortly, so i just wanted to ask one more thing. if i prepare the prenuptial in UK and bring it with me to Morocco, can my fiance sign this in the presence of the Adoul and would this then make the prenuptial valid in the UK?

Well of course it is! The Adoul is a Moroccan lawyer, but you will have to have it translated into Arabic.  All assuming- there’ll be an English pre- nup and an Arabic one too!


Hopefully your partner will have drawn one up too, for you to sign!

yes indeed, i have asked her to draw one up and have offered to pay the additional costs, to which she has agreed.

@MrT786 Hi. As advised you can write the conditions of marriage you want included which will be written on the actual marriage contract with both of you will agree when you both sign the marriage contract. Both of you can include your own conditions.


It is like a prenuptial agreement but written within the marriage contract itself. It's not a seperate prenuptial agreement document that you bring from your lawyer UK which is going to be attached to the Moroccan marriage contract. It doesn't work like that.


You can write down the conditions you want to be put in the Moroccan marriage contract and adoul will write these into the marriage contract.


would this then make the prenuptial valid in the UK?


You should seek legal advice from your lawyer about this and you should talk with an adoul in Morocco to explain you want to include conditions of marriage in the marriage contract.

@MrT786 and as RR says the adoul is a laywer and the marriage contract they will write you is a legal document recognizing a legal marriage performed in Morocco which is recognized in the UK and elsewhere.

Hi they are  grey area even in UK courts and expensive basic one costs abour £1500 upwards .  but get legal advice asap i think

i decided to take another route as i wasnt happy with certain aspects of the pre-nuptial.

@marybell5403 - you aint wrong there! its a legal minefield! 'Grey area' aint the word! if you really want to fry your brain, get into the legal system.


anyways, as i said, the costs, and certain aspects of how the Pre-Nup is prepared and set-up,  wasnt to my requirements. so i have decided to take another
