British National married to Moroccan seeking divorce

Hi All,


i was hoping If someone here could offer me some guidance for my situation for which I would like to thanks in advance 1f64f.svg


I am a British National who married a Moroccan girl about 4yrs ago now. She’s here in the UK on spouse visa and she just had her first extension after spending the first 2.5yrs so she still has another 2yr or so before she can apply for naturalisation and British passport.


Unfortunately things are not looking great for us and that’s neither due to anything sinister but just massive compatibility issue.


i just wanted to find out if I was divorce what sort of loopholes I would have to go through. I would have to file the divorce in Morocco I’m guessing but most importantly, if I am the one who will be filing for divorce, what sort of money/funds/share might I have to pay her.

Since you have no kids, you are only obliged to pay her the money of "sadaq" which is listed on the marriage contract. That's all.

Hopefully you didn't put a ridiculous number since I know many guys put a high number to prove that they will not divorce.

Thankyou Isabella for your quick response. I have the marriage contract but the only amount mentioned is there is for the dowry is this same as Sadaq? There is no other mention of any other payments on the marriage certificate.


also, hope you don’t mind me asking this but can you tell me how certain you are about your response and it’s validity. Have you been through the process yourself ?

Well that I’m aware of as it’s standard everywhere in most countries, just wanted to know if she doesn’t agree for a mutual consent

@novemberalpha As you reside in the UK and that's your country of first residence, you can divorce in the UK and then, later on on, register the divorce on the Moroccan civil register. Nevertheless, without children, Moroccan courts should be more favorable to you than UK ones;


And yes, sadak, dowry or mahr are the same.

marriages in Morroco are legally recognised in the UK. so if the divorce took place in the UK. what would the courts likely give to the divorcee? based on the spouse not having a full citizenship, and still being on the first part of the 2.5 years visa. thanks for any info

I am not sure what the courts might ask me to pay here for her being only 2.5yrs on spouse visa but I really just wanted to get guaranteed confirmation of what I would pay In Morocco

Do your divorce in the uk, her visa will become null and she will need to return to Morocco since she will have no ties to the uk.

You can register your divorce in Morocco once it's completed. I don't know how to do that since I got divorced in Morocco.


I refused my rights to alimony ( I have children and I'm not moroccan)

I just wanted my divorce.


If you apply for divorce in Morocco ( which makes no sense since your residing in the uk and the uk accepts your marriage as valid hence her visa) then you will have to pay alimony not dowry.

Dowry is paid when you marry her, the court here in Morocco you will be forced to pay her alimony which she can request an amount or the court will decide an amount.

It could be 2000 to 10,000 per month for 3 months ( iddah)

British court won't make you pay anything, just fill in the paper saying the marriage has broken down due to the behaviour / culture of your wife.

This is the mutual break down of a marriage.
