Hi guys, please I need a help with this matter. I'm a new employer who want to transfer the iqama of one domestic helper without approval of the old employer, because her iqama was expired 5 years ago.

Can I send her a transfer request through QIWA and we transfer without approval of the old kafeel?

If, so, what should I also do to legalize her iqama after 5 years being expired?

Thank you very much in advance.

Hi! Unfortunately, transferring the iqama of a domestic helper without the approval of the old employer (kafeel) can be complicated, especially since the iqama has been expired for 5 years. According to Saudi labor laws, you generally need the current employer’s consent for a transfer unless there are exceptional circumstances like labor disputes or violations.

Here’s what you can do:

Check Qiwa: You can try submitting a transfer request through Qiwa, but it may require old employer approval, especially given the expired iqama.

Contact Ministry of Human Resources: Reach out to the Ministry of Human Resources and Social Development (MHRSD) for guidance on whether a transfer is possible without the old employer's consent due to the expired iqama.

Renew the Iqama: You’ll likely need to settle any outstanding fines or penalties related to the iqama’s expiration before renewing it.

I recommend consulting with an expert on Saudi labor laws or a legal advisor for proper guidance. Best of luck!
