termination without notice

Hi everyone,

Can someone please help me with the following questions pertaining to termination of employment contract in Kuwait:

1) If a company terminates on "poor performance" basis (despite getting excellent performance appraisal for 6 years) AND doesn't give the 3 month's notice period, what are the options for the employee? Can she take the matter to court and get 3 month's notice period?

2) If a company terminates a person without notice period, how long does the employee have to find another job and transfer Iqama?

You can go to the ministry of manpower the dispute office and file a complain.  The definitely have to give you 3 months notice or else pay you 3 months if they didn't want you to be in office.

You should complain in my view for the 3 months notice and for letting you go for poor performance despite 6 good appraisals. Specially if you haven't made any mistakes that costed the company any financial loss.

That will also help you get temp residency on government to get another sponsor. As your company may want to cancel your residency. And nake sure you get your indemnity otherwise you'll also have to take them to court for that if they are reluctant to pay.

Go to the public authority of manpower center to which your company belongs and better have an Arabic speaker present with you as many do not speak English there.
