Hello Guys,

This is Manoj Vishwakarma and my question is related to Single Permit.

My Employer had applied for the renewal of WP (now in new process it's Single permit) in Mid of Feb 2019 and as a part of single permit, first level of approval (work authorization) was granted in Mid of March 2019 and now it's pending at foreign office for resident approval until now (almost 6 weeks)

My current work permit is expiring on 30th-APR-2019 so would like to know, can I continue working for my employer ? Or shall I only go to office once I have an approval from foreign office on single permit ?

Is there somebody have already gone through the situation ? or are in  same situation like me ?

Could you please suggest ?

One more point to add : I live in etterbeek commune and when I checked the same in commune they aren't sure so do you suggest any specific institute to check on this ?

Your employer can give you an official answer on this. If they say you can work, you can.

Do your job. But do not leave the Belgian territory until you have your file up to date.

HR team is checking with legal teams meanwhile I asked the question to etterbeek ,1040 commune today and according to them we can keep working.

So to share the update on this,

my employer legal team have advised me to not to come to office until they get the final approval, just to avoid the legal issues if any.

i heard few employer have allowed their resources to continue working based on first level of work authorization and seems its employer to  employer basis.

it weird that we don't have  common rules on ground.

Usually, how long will it take to complete the process in immigration/foreign office? any idea?

I don’t think there is an official answer for this
It’s case to case but in most of the case 6-8-10 weeks
In my case I am still waiting for an answer from ministry since last 7 -8 weeks so as others

I don’t know Incase some body have already got the answer in this group ?

if you are filing from flanders, you can ask your question through email to arbeidskaart@vlaanderen.be. They reply back - i checked with some other question

Anyone has a mail I'd to check the status of second level of approval (foreign/immigration office) for Brusells region?

No. To get a confirmation on if you can work only with WP approved or should you wait till Single Permit.

It depends on the client you are working at, if they allow to work (which in my understanding is OK as long as you have the WP approval letter) it should be OK. after WP approval it can take 4-8 week to get Residency approval. Some clients are not allowing to work such as some banks till you get everything approved.

I am just following this  post cos  I'm in the same situation.  WP renewal applied on March 11th and work permit approved  on May 1st, now I am waiting for the  residence permit  approval to start working.  Though my current residence permit  is valid until August I don't  get the  point why  would I require a new residence  permit  now and a wait time for 4-6 weeks for this seems ridiculous as I have been living in the  same address for  3 years.

Hello Arun, It depends on your Employer/Client. With WP approval letter some clients allow to work and some don't such as EC, KBC etc. Check with your work place client.

Hello,
I am recently changing my job in Belgium from Indian expat contract to new Belgium company contact.
My last date in the current company is 20th Nov. New work permit is applied on 4th Nov. But my new work permit is not yet approved by the authorities. I am worried what would happen if even after my last date with the current company my new WP does not get approved.

Will I be able to stay in Belgium till my new work permit get approved?
Will it be called a gap in my employment? Can it cause some issue in my Permanent residence case in future?
Is there a way to know the status of my Work permit application?
What is the current time for new work permit in Flanders region?
Can I ask my current employer to extend my last date?

Kindly help me here.

Hello,

if the new wp is not approved yet, it means you can't work for you new company (yet).
==> no salary as you can't work anymore, until it's approved.

You can obviously stay in Belgium for a time, until you either get your wp approved or you receive a formal order to leave the country within 30 days. (OQT / "Ordre de Quitter le Territoire")
Hopefully for you, the administration/immigration is a bit slow, so basically they know you've a new wp pending and they won't move a inch for a while before sending the OQT.
If the WP is not approved, then consider you've 30 days to find another job or you'll have to leave Belgium.

No gap as long as your A card doesn't expire or is in a renewal process for your new wp.

Consider a "big" month for the delay. (can be faster depending on the workload they have, but renewal never exceed much of a month...)
