I had found support in this forum while I was waiting for the decision on our application for my Residence visa, thus I would also like to share our experience.
My boyfriend is a citizen of the UK living and working in Holland for about 5 years before he was assigned to a project in Dubai where I was a residence on the basis that I was working there. After a year in Dubai, my boyfriend had to go back to Holland as the project was over.
We didn’t know much about the processes available of getting me in Holland especially because we were not married. We read a few things on the IND website and it didn’t occur to us that we can actually make use of the EU community law. When we applied Brexit was meant to happen on March 31 of 2019.
My boyfriend called the IND for advise and he was given the earliest possible appointment applicarion which was 29 of March and in Eindhoven(which is far for us) , but that was the only schedule available before brexit. I flew to come here from Dubai on the 27th before the appointment on the 29th of March. I was immediately given the sticker after we submitted a lot of pictures and other evidences that we did live together in Dubai. ( as well as the rest of the requirments on the list)It was not easy to prove hello hat we shared a household because it is not uncommon to not have a registered address in Dubai. All we could give were a few nails and online purchases that has been sent to me to the apartment hotel. We, however had lots and lots of pictures and tickets of our holidays together and my tickets of flying to Holland and him flying to Dubai for those 5 months that we were apart.
So I flew for the appointment (I didn’t need a facilitation visa as I had a multiple entry schengen)
The lady who received our application asked me if I’m already living here in Holland. (I was confused with this question) I told her I don’t and didn’t think I could. And she said I can now with the endorsement sticker. So I left and pack my stuff in Dubai and came back here only on the first week of April. After which I registered at the gemeente on the 14 of April.
We didn’t hear anything from the IND even a week after my sticker had expired so I called to ask what I have to do. I was told to make an appointment online to extend my sticker.
At this point I was getting really worried why a decision has not been taken and wonder what we will do if this came out negative as I already left my job in Dubai. I was hopeful somehow because maybe they were just waiting for me to hit 6 mos of officially living in Holland(registration in Gemeente date) which was the 14th of October. The 15th of October came and still nothing. The 16th came and nothing... still. I was even scared but I mustered enough courage to do so, and the lady who answered said “oh we had just made positive decision on this case today...” and I interrupted her and even ask , “uhm did you just say it’s positive?”
She continued and said yes we had made a positive decision on this case and we will send you a letter stating this. I was still in doubt about this and my mind was racing thinking I can’t just believe this until I get the letter. Today 18th of October I finally received this letter stating that they intend to give me the residence and that another letter will be sent to inform me when and which IND desk I can claim the residence card from.It was such a relief.
For anyone of you who are going through this , just hold on and try to stay positive even with the long wait. It could just be the gemeente registration date or they could just have work overload. And when you call the IND they will try to help you the best way they can.
Thank you for taking the time to read this and I hope this could help those who are in that same situation right now.
regards,
B
