My E-Pass renewal is rejected. What should I do next?

Hi Everyone,

I would be very grateful if someone that went through this experience before could share a bit with me.
My E-Pass renewal was rejected, and so the appeal. I still have two more months of my current E-Pass, so my questions are:

Once these two months pass, will I forced to resign, or will the company fire me? Does it make a difference in terms of compensation?

Do I have to leave SG before the last day of my pass?

Grateful if anyone can share some experience about this, even if not very related to my two questions...

Your employment will automatically end when the EP expires. No need to resign or be fired.
You will automatically get a 30-days SVP after the EP expires. In that time, you must clear up your matters (e.g. rental contract) and leave the country.

There are no rules for compensation in Singapore, other than what is written in your contract.
Since the rejection is not your fault, any penalty given in the contract for resigning without sufficient notice does not apply.
But the employer has to withhold your last month pay, clarify your tax matters with IRAS and pay the tax dues from the withheld money. You will get the remainder, if any, paid out afterwards (usually within a month after leaving).

Hello Everyone,

My situation seems bit similar to this thread.

I am indian staying in singapore for 2 years now. My present EP will expire on 30th june. My renewal application got rejected.   So then the another company in singapore filed an S pass for me and it got approved (Received IPA last week). On the other side I received another offer from overseas and I want to take that offer. So basically even I am having an IPA I want to leave the country before 30th of june. Is that possible?

Please guide me how to do the leaving formalities as I have heard that I need to get the tax clearance certificate plus I need the cancellation of pass and Specail pass for 1 month from my present employer.?

I have paid the taxes for last 2 years without any dues.

I still did not resign from my present job yet, Please suggest how to stepwise do the formalities.

Hoping to hear your feedback.

Andrea_stv Pleas may I know the reason for renewal rejection if you are aware of it, reason I am asking is because even my company is going to apply for my conversion case S Pass to E Pass, I am satisfying the new salary bars set by MOM, just curious about your case.

Madymahi: If your present employment ends on 30. June, you do not need to do anything there - except informing the company that you will not stay on in Singapore, so they have to withhold your last month salary and do the tax clearing with IRS. If you want to resign before 30. June, you must keep the contractual notice periods - or find an agreement with your employer.
Then you have to check whether your contract with the new company allows resignation before start of work. If it does: Resign, fulfill all the requirements for it in the contract - and never convert the IPA into an actual S-Pass. That's all!
If the contract doesn't allow resignation now, you have to either start work there and then resign, or find a mutually agreeable solution with them. Since the former is usually not in their interest, I believe a solution will be found.
Please note that getting an IPA and then changing your mind will leave a negative mark in your profile at MoM. But if you do not plan to return within the next few years, this might not matter.

Actually I want to leave singapore before my pass expires lets say 18th of june. In that case also my present employer does not need to cancel my pass? Can I still leave country with IPA even if my present employer cancels my pass?

Actually the singapore new company application(S pass) was ongoing since so many days and I lost my hope on that. On the other hand the overseas job also was not sure that I will get through it.

But you wont believe I got both the approvals on the same day. I thought even if one of them gets rejected then I have another one. I also dont like to take multiple options at the same time but the situation made me to do so. Since last week I was not having anything in my hand, frustating days.

I was thinking of clearing the immigration first and then emailing the new employer from singapore that I can not join (Maybe due to some family reasons). Because lets say if I couldnt travel due to some reasons for. e.g Sudden Covid lockdown or some serious reasons then I will join them as no other option left.

I clearly understand your concerns that while having an IPA and leaving the country is not a good sign but i dont have choice also. In this is it mandatory to inform the new employer, will it not work if I tell them once I clear immigration and board the flight?

I think you misinterpreted me. What I said is:
The immigration aspects and formalities with MoM are not an issue, but your contractual relationship with both employers (current and new) are a potential problem. If you do not properly resign from both, or at least find a mutual agreement, they can report this to MoM (possibly leading to a ban from future employment in Singapore) and they might even be entitled to payments from you for damages (as you did not fulfil your obligations from the contract).
Giving an untrue excuse (like that you cannot join for "family reasons") is dishonest, morally dubious and - most importantly - does not change the above legal situation at all.

Thanks for the clarification. I got you correctly now.

I will talk with my present employer and will find a mutual agreement. Also look for options to settle down with the new employer. (will check the contract first for such a clause)
Another case even if I dont take overseas opportunity then, that company as well as the country will have bad image about mee too as I already got the visa approved too. That is one of the country I wanted to settle down in near future.

If I understand correctly, I can still leave the country on my EP ? even if lets say I settle down both the companies in singapore.?

Of course you can leave - meaning nobody will (or can) stop you at the border or airport.
But it is better to leave without burning bridges behind you!
