Help with newly setup VvE

Hi everyone,

I purchased an apartment in Delft in 2017. The building has other two apartments (one the same size as mine más the other one half or it). Only very recently the VvE was setup, and we asked a company VvE beheer to manage it. The company came back to us with a budget proposal for the first year of the VvE that seems reasonable. However, in the meantime my situation at work has changed and I have to leave look for another job. I don’t know how long this will take, but eventually I’ll have to sell the apartment, in which case that original budget is no longer reasonable to me because I would be paying for a fund I will not be able to use. So I have stated to my neighbors I do not agree to that budget, to which they have replied that I have to pay my share anyways since they are majority. So I have multiple questions:
1. I have signed recently a document where I agree that VvE beheer manages the VvE. Is this something that can be reverted anyhow?
2. Am I obliged by law to make these payments even if I know sooner or later I will leave Delft (and most likely the Netherlands)?
3. Is it true that because they have majority of the vote (2/3), I have to abide to what my neighbors decide?
4. I heard there’s the option of a dormant VvE, is this still an option in my case even if my neighbors don’t agree to it?

Any help is greatly appreciated. Thanks in advance for the answers.

Hi and welcome to the Forum.

Sorry to hear of your circumstances.  In an apartment living situation in the Netherlands, the Vereniging van Eigenaren (VvE) is required by law; you don't only own your apartment, but legally you and the other inhabitants are responsible for the maintenance and upkeep for the whole building.  The day you bought your apartment, you became a part of the VvE for that building.  You may not leave it, or opt out of it until you sell the apartment.

To answer your specific questions:

1.  No.  The VvE is required by law.
2.  If you have made a contract to do something and wish to change it, you need to go and speak to whoever the contract is with and explain your circumstances.
3.  Don't know, but it seems the way that Dutch people would do things, it's democratic.
4.  Never heard of them and neither has the internet, so I suspect that if it exists, it has a different name.

You should be aware that if you cease paying your VvE costs, then your mortgage holder may well, ultimately, foreclose on your mortgage.
