Eligibility for 30% tax ruling in Netherlands

Hello,

I am presently working and living in Belgium since 29th August 2020. I have received an offer from a  company in the Netherlands and the job location is Amsterdam. I am planning to accept the offer.

Prior to living in Belgium, I was living in India and the US. My question is since technically I did not live in Belgium for the complete last 8 months of last 24 months (still around 9 days are remaining) could I move to India in 3-4 days from now and then move to the Netherlands just one day prior to my joining date. Doing so, I would have lived more than 16 months of the last 24 months 150 KM away from the Dutch border.  I could show my passport stamping, air tickets, and other utility bills of India to prove my residence in India.

Would I be then eligible for the 30% ruling. I fulfill all the other requirements and would definitely want to be eligible for a 30% ruling.

Are there any other alternatives? I have got a very limited time to make a decision. 

I would greatly appreciate any guidance and advice in this regard.

Hi and welcome to the Forum.

The rules for the 30% tax rules are explained on the Belastingdienst website; this link will take you straight there.  Our experience of dealing with the Belastingdienst is that they don't deal with "technicalities", you either qualify, or you don't.  If you leaving Belgium for the time you state would bring you within the rules and that is what you want, then that would be my advice.

One other requirement of this is that both you and your employer must agree that you qualify.  So my advice is that if you both agree, that your employer approaches the Belastingdienst and asks there.

Thanks for your prompt response. Yes, my employer and I have already agreed on this and I have gone through the details of the requirements. This was the only requirement for which I had doubts.
