How easy is it to retire to Portugal?

Post new topic

Golden_Light

How easy is it to retire to Portugal, what is the process for a permanent move.

I would love to move to Portugal or Spain

I have dual Canadian and British citizenships. after immigrating to Canada for 30 years I would love to retire back to Europe with my preference being Portugal or Spain.

In a post Brexit world, things seem a lot more complicated. Is this even possible?

Hi Golden_Light, Welcome :)

As you are a British citizen, you can start by looking at this link:

Bump  ;)  We would be arriving from Canada as we moved away from the U.K. 30 years ago.
All our ties, and assets are (for now) in Canada..

We are not sure of the tax implications - any good international expert out there? Should be keep our investment property in Canada (for the income) or sell it..
Not sure how our Rental income would then be taxed on it in Canada or in Portugal.

There is good information online, however "official" sites are often confusing as sometimes information is missing if it's not in Portuguese. (Most often at Consulates you are working with in your previous country).
However, there are some very good tax lawyers in Lisbon and elsewhere that help you cut through the detail. A small word of warning is that they will not actually do the tax compilation, but advise on options for the structure you wish.
You will need to find a Tax Accountant to do that for you. This is where I am right now in my Residency 'journey'.

Hi Golden Light,

If you are tax resident in Portugal, the rental income you receive are taxed at 28% of that amount ( same as the capital income tax). But you can deduct the condominium expenses, the maintenance expenses and the property tax from the rents you receive.

You can also request the status of non habitual resident, and this way, obtain some tax benefits, described here:

https://www.expat.com/forum/viewtopic.php?id=911492

If you remain tax resident in Canada, you will pay tax on your income in Canada.

For tax purposes, the following are considered tax resident in Portuguese territory:

      - who has stayed in Portuguese territory for more than 183 days;

        or

      - having stayed less time, has in Portuguese territory, on the 31st of December
        of that year, a dwelling in conditions that make the intention to maintain and
        occupy it as habitual residence.

We would be looking at retiring to Portugal full time - Using D7
So what is the 10 year 'tax holiday' exemption for that I see people talking about ?

We would have a rental property in Canada as well as a small amount in a couple of other accounts.

JohnnyPT

That "tax holiday" exemption is the non-habitual resident regime explained in the link I gave you in my previous post... you have to read that to understand what it is about.

Hello JohnnyPT,

I am confused by quoted from above
      - having stayed less time, has in Portuguese territory, on the 31st of December
        of that year, a dwelling in conditions that make the intention to maintain and
        occupy it as habitual residence.

In the eye of Financas, what would make an apartment be in conditions that it could be used as habitual residence? I have seen expat holiday homes that have everything to use it all year round, but that are only occupied for a few weeks per year.

Hi Tom, please read this (need translation):

"Portal das Finanças" AT Website:
https://info.portaldasfinancas.gov.pt/p … irs16.aspx

Artigo 16.º

1 - São residentes em território português as pessoas que, no ano a que respeitam os rendimentos:

a) Hajam nele permanecido mais de 183 dias, seguidos ou interpolados, em qualquer período de 12 meses com início ou fim no ano em causa;

b) Tendo permanecido por menos tempo, aí disponham, num qualquer dia do período referido na alínea anterior, de habitação em condições que façam supor intenção atual de a manter e ocupar como residência habitual;

For other issues you will need to check with the AT.
