Hiring Employees for new business.

Sorry if this has been talked about dozens of times. My time to researching has been dedicated so far to CPFs, Proof of Residency, Visas, etc, and etc.


Now I will be scrolling though the old forums about hiring employees.

This is for obtaining a Vitem IX - business investor visa


My employees will be friends I will hire

@antonioggriffin Hi Antonio - I am a little confused... We have talked on this forum and privately, and discussed the difference between a business investment visa (VITEM IX) and the residential (Golden Visa) program.


Previously you said that you have already invested sufficient to qualify for the Golden Visa (1 million reais or 700k in NE Brazil, into residential property), and have the exchange documents to prove the transfer of funds was made in the correct manner? If so, then all is great.


However you are now mentioning the business investment visa (min R$500,000 investment). However this visa cannot be granted for residential premises, unless the residence is an intrinsic part of the investment (like a hotel or pousada). Renting a room through AirB&B, for example, will not qualify. Furthermore you need to create the business first, then invest into it, and it must be the company making any purchase. This visa is granted on the investment into the business, not the purchase of any real estate.


If you have already bought a property in your name, then you will not be able to use it to qualify for the business investment visa. Additionally the Federal Police will visit your business premises to verify that the business is genuine, trading and employing Brazilians.


To the question you actually asked, what nationality might your friends be? If they are Brazilian - great, because one of the conditions of the investor visa is that you create employment for Brazilians - not foreigners.

Yes, you discussed the differences. But the person who I think you are thinking about was an Expat name Headshot if I'm not mistaken. He's already made all purchases to qualify. I haven't spent any money yet.


And yes all the employees would be Brazilian.

Here's the regulation that serves as the basis for the VITEM IX.  It's complicated and has many moving parts, so even if you speak good Portuguese, you should run it through a translator and read both versions as carefully as you can:

Note that whether an investor comes into Brazil on a VITEM IX or is already in Brazil, s/he needs to have a detailed business plan reviewed and approved in advance by the Ministry of Labor.  The resolution also seems to assume that an applicant applying from Brazil is already a legal permanent resident, which doesn't seem to make much sense.


For these and other reasons I suggest, as I think I have before, finding a professional who's done this before to advise you and represent you if this is really the way you want to go.
