TTTD - The new school year is about to start but the old location is no longer available, and plans to move to the new location have not been implemented. Many students' families have already paid school fees in advance but still do not know where their children will study.

Recently, parents of students of Green Buds International High School, Middle School and High School have reflected on the school's plan to close and move its activities to another location in Da Nang City. After receiving the information, the Department of Education and Training (Education and Training) of Quang Nam province set up a team to inspect and grasp the situation of the school.

New school year approaching, students do not know where to study?

According to the report of Quang Nam Department of Education and Training, Green Buds International High School, Middle School, and High School (formerly known as Green Buds International School) was licensed by the People's Committee of Quang Nam Province to establish under Decision No. January 2014; Renamed according to Decision No. 3632/QD-UBND dated 12/11/2019. A representative of the Quang Nam Department of Education and Training said that based on the work results and reports of the school's principal, and at the same time capturing information through discussions with Ms. Catherine McKinley (the school's investor), the first stage of its establishment was (in 2014), Green Shoots International High School, Middle School, and High School have a small scale. Most of the students at preschool and primary school age are children of foreign nationals living and working in Hoi An city, Quang Nam province.

From the middle of the first semester of the 2020-2021 school year, the COVID-19 epidemic caused the Green Buds International High School, Middle School and High School to face difficulties in teaching and learning, especially in enrollment. Because it is a private school, tuition revenue has decreased, so activities have been affected.

It is known that from 2022, Green Shoots Education Vietnam Co., Ltd. has signed a contract to rent the location of Hoang Sa High School, Middle School, and High School. By the end of the school year 2022-2023, the school has enrolled 95 students through the use of records of Dai Thanh Quang educational institution, on the basis of signing a space lease contract with this company. The majority of students have foreign parents (only 11 students of Vietnamese nationality), the staff, teachers and school staff consists of 43 people.

However, in July 2023, the company announced its plan to move the location to APU-American International School, based in Hoa Hai, Ngu Hanh Son, Da Nang. Through information exchange with Quang Nam Department of Education and Training, Ms. Catherine Mckinley confirmed that up to now, the two sides could not sign the contract due to disagreement on terms.

The new school year is about to start, the old location is no longer available, the plans to move to the new location have not been implemented. Many students' families have paid tuition fees in advance, but the school owner has stopped the contract with teachers and staff.

A representative of the Quang Nam Department of Education and Training said that she had contacted Mrs. Catherine McKinley, the investor of the Green Buds International High School, Middle School and High School, but she has not returned to Vietnam to solve the above difficulties.

Talking to a reporter from Tuoi Tre newspaper, Mr. Thai Viet Tuong, Director of Quang Nam Department of Education and Training, said that in order to promptly coordinate with relevant authorities to solve the situation, help stabilize students' learning. , the Department of Education and Training has asked the People's Committee of Quang Nam province to send a document to the British Embassy, asking Mrs. Catherine McKinley to return to Vietnam to coordinate the settlement.

The international school was sued in court

In another development, Tuoi Tre Newspaper received an application from Dai Thanh Quang Joint Stock Company, requesting to reflect the objective truth, related to Green Buds Education Vietnam Co., Ltd.'s breach of contract and application. method of terminating the property lease contract, causing damage to the enterprise.

According to the content of the complaint, Dai Thanh Quang Joint Stock Company (Dai Thanh Quang) has the property as the land use right shown in the Certificate of land use right, ownership of houses and assets attached to the plot. On January 25, 2022, Dai Thanh Quang and Vietnam Green Shoots Education Co., Ltd (Green Buds) signed a contract to lease land use rights and assets attached to the land.

Accordingly, Dai Thanh Quang leased a part of the area as well as the architecture to the Green Shoots, which are works for education, including: Security house, garage, 2-storey classroom building, classroom block house. 3 floors, boarding house, kitchen.

On June 1, 2022, the two sides continued to hand over assets attached to the land according to the ground handover minutes No. 02/BBBGMB-DTQ.

Under the agreement, rent is paid in 2 installments per year. However, Green Buds have only paid 2 installments and since then have not paid any more, nor continued to carry out construction despite Dai Thanh Quang many times sending reminders.

Dai Thanh Quang Company believes that Green Shoots Education Vietnam Co., Ltd. has violated the provisions of Article 7.1.4 of the contract and Article 8.1.3 of the contract appendix.

However, after that, Green Buds unilaterally terminated the lease contract with Dai Thanh Quang, causing students to have no place to study.

“The enrollment and receipt of tuition fees of students while the land is not available, the facilities have not been built, and then try to transfer the number of students recruited to another institution shows signs of violating the regulations. the provisions of the Education Law 2019 on conditions for school establishment and conditions for permission to conduct educational activities; Regulations on tuition fees and costs of education and training services, "said Dai Thanh Quang's representative.

"According to the newly updated reporter information, Dai Thanh Quang Company has carried out the proceedings against the Green Shoot Education Co., Ltd. to the People's Court of Hoi An City.
In the lawsuit, this company said that Green Buds Vietnam Education Co., Ltd took advantage of signing a contract with Dai Thanh Quang Joint Stock Company to have facilities and learning environment with an area of 20,000. m2. When obtaining the number of records of teachers and students and collecting tuition fees, they tried to transfer these students to another institution and unilaterally terminate the contract, causing great damage to Dai Thanh Quang"

"...send a document to the British Embassy, asking Mrs. Catherine McKinley to return to Vietnam to coordinate the settlement."

Seriously? I'm not sure, but that doesn't sound like the route a formal extradition request should run. Perhaps a Google translate issue.

Is this her?

Pretty fancy-dancy home page (Link), the best (other people's?) money can buy

@Aidan in HCMC the problem is that she is not Vietnamese and she has returned to her home country, so the temporary authorities do not have the right to arrest her but have to go through the foreign ministries of the two countries to work and summon her back. , that's why most foreign companies have to have a representative in Vietnam to take responsibility rather than receiving money and then returning home without having to bear any responsibility like that.

That sounds exactly like the "...formal extradition request" I mentioned.

Understood, of course. I wonder whether the local patsy is getting very nervous, right about now.

Definitely no new school year for Green Shoots, with an estimated ₫14 Billion VNĐ unaccounted

I'm not sure what to make of this. I looked at this school for my children for this year (but in the end we decided to base ourselves in hanoi where there are more options)

I'm not surprised to see photos of the old site abandoned, since they were very clear that they were moving to APU in DaNang, but I am surprised to see that final agreement wasn't reached on that rental deal?

The school's facebook page is still active, they do seem to be still operating and they currently give their address as A1 Block, Sentosa City Urgan, Dien Ngoc Communie, Dien Ban District.
