Tenant Rights in DR

Greetings,

I recently moved to the country three weeks ago.  I found a pretty decent apartment in Santo Domingo, made a contract with the landlord, put down the deposit (2x1).  The landlord had agreed to have the apartment ready for me by last Saturday, the 21st .  However, she failed to meet the agreement and it is a week later and I have yet to receive the key to the apartment. Point being is that I am no longer interested in renting the apartment due to her ways and I want my deposit back. I keep calling her and requesting my money back but she says she's is busy, ignores my calls, etc. 

Any recommendations on what steps to take? What are my rights?

Welcome to Santo Domingo and to the forums. I am also in SD.  Okay this is going to be a tough one for you. I suggest contacting a lawyer now!   This is not unusual, they will rarely meet deadlines here.  IT may also not be grounds to break the lease!

People get away with this crap because they have no fear of retribution!  I may be anachronistic, but I believe in knocking on their door with a baseball bat.  Judge Roy Bean was a fruitcake, but the fear of him kept most people in line. When the law means nothing , the fuck you mentality comes to the fore.  Too bad that fear is the primal teacher. I wish you well in your quest for a quick solution to your getting screwed.  In many cases, the old days were better. I am not suggesting violence at all, after all, these are not Biblical times, or are they?

As guests in this country it is absolutely inappropriate  to suggest anything like this on a public forum. Taking the law into your own hands gets you put in jail or killed.

Sadly it is our responsibility to understand our rights and obligations and that is not easy here.  This may be a lesson learned situation.

Keep going to the apt to try and track this person down. Don't go alone. Don't take a baseball bat or anything like this.

I hereby apologize for suggesting that the "Bad Guys" be punished in a timely fashion for their illegal ways. We should accept that it may take an inordinate length of time to receive justice, if ever.  Have patience & believe in "Karma".  We must follow & believe in the laws of the land as we are guests here & it will always be so.  Sorry for the "F" word also.
