UAE inheritance or succession law

Hi,

My name is Joel and I live here in Sharjah, UAE for about 5 yrs now together with my father and mother. Last year, my father went back home in our country, Philippines, to seek medical assistance but unfortunately died of his sickness. My mother, after the incident, decided to go back home for good. I was left here in UAE with a car under my late father's name that i would want to transfer under my name so that i can apply for the renewal of the car's registration. As advised by my lawyer, i need to go to court, together with 2 witnesses to prove that i am a legal heir. If in any case, the judge disapprove of it and reject my plea, will there be any consequences to it? will there be consequences also for my 2 witnesses? what will be the consequences, if there is any..

No consequences.  The court will decide the succession.  In the absence of a will for non-muslim expats, they will adjudicate according to UAE laws.  I don't think it will be as easy as two witnesses and so on.  They will ask for quite a bit of documentation.

Thanks XTang!  Youre response was highly appreciated! I'm just a bit worried because my lawyer informed me that the court might file a case of perjury to me and my witnesses if the hearing doesn't go well..is there truth to this?

And pertaining the documentations, would you know what kind of documents I would need to prove that I am a legal heir?

Why would they file a case of perjury?  that would only be the case if someone else has filed a claim to your father's estate.

In the absence of a WILL, you will have to open an Inheritance case in the Personal Status Court in Dubai.

You have to submit passport copies of your father and of the family along with his visa page as well as an attested death certificate.  The two male witnesses come after this and they will attest to the relationship of the applicant for the Legal Heir certificate with the deceased i.e. he was your father.   They may also ask for a power of attorney from all surviving heirs to you to be able to apply.  As I said, it is not a simple matter.
