Brazilian with stable union to American traveling to USA

I am an American citizen planning on traveling in October to the USA. I have a stable union with a Brazilian citizen that is documented and want to know if she will be allowed to travel with me. She already has a tourist visa that is valid 5 more years. I have read that immediate family members are allowed but I need to know if the USA will recognize the stable union from Brazil as an immediate family member. Has anyone experienced this?

As far as I am aware, only immigrant visas are being processed at present.  Non immigrant “visit” visas are not.

I asked a while back concerning a similar situation; apparently some customs agents take a rather dim view of spouses/partners simply visiting.  That being said, don’t volunteer any information that you haven’t been asked.

You probably wouldn’t have an issue, but if your union is documented at the cartorio, etc., it wouldn’t hurt to take a translated copy as proof of sorts.

As said the main item will be your stable union documents being translated into English as 13of Clubs said.
Go to the CBP website. There is an email site to email them. It takes a week or more for an answer, but you could get your answer. I did this for my step-daughter in January and they asked her to fly to another country for 15 days if I was not accompanying her. (Before vaccine).
If you can get to Las Vegas and want to marry in the USA. That will take care of the issue from then on. Not romantic but really helps.

My wife can now come in go, with a valid BR passport without me. To see her daughter.
Also, she can be in the US citizen customs line and save a lot of time.

Please, be very careful.
In the U.S., the USCIS takes a very dim view of people entering the USA with the intention of work or marriage if that person does not have the correct visa prior to entering. If the USCIS determines a person has the intention of entering the USA to marry, without already having an approved K1 Visa, not only can that person be deported, but can be subject to not being able to enter the USA again for up to 10-years.

I am legal immigrant to the USA, as is my wife; both also U.S. Citizens.  In addition to teaching ESL In the USA for free, and U.S.Citizenship classes, I have done the immigration paperwork for a number of people over the past 18 or so year's, both with K1 and K3 Visas, often after some immigration attorney has caused delays or denials. Too many of them do not stay current with the constant changes in U.S. immigration law and policies.

There is no intent to marry if married in another country. She was my wife and I had the marriage translated. When we visit Las Vegas, we said why not?
Went without a hitch and went back to Brazil in 10 days. now, all is fine. she is not going to work or live in the US. Too big of a family here.

Ive got a similar situation ....stable relationship going back several years on tourist visas ....so my partner has a Brazilian passport but cant get an interview even to travel as a tourist to come back with me...
A friend of ours said last week that we can travel to Mexico and quarantine in a hotel for two weeks, and then gain entrance to the USA ...has anyone ever heard of this procedure?  She would still need a visa, how does she get one in Mexico, say, Cancun .....or is Panama City another option?

Looks like the closest US Consulate to Cancun is in Merida.  You might want to email them to see whether they can process a visa for her there:

Not quite the same situation, SD is studying in the US and has a visa, but she still had to go to Mexico for 15 days and then test. If neg test she could enter.

HI, I would not the USA would recognize a stable union from Brazil.
It is best that your partner travel on a tourist visa. Upon arrival in the USA
only answer questions that are ask. Most people volunteer too much information.

I think there is a little confusion about going to Mexico. The reason Brazilian go to Mexico because Biden has a block any one coming direct from Brazil saying it a high Covid country. I am not even sure if you being a US citizen coming straight from Brazil could get in to the US. I heard many people from Brazil are going to Mexico for 15 day before going to the US. So it’s not to get a Visa. You still have to go through a US approved process if you are a Brazilian in Brazil. To get a Visa like Visitors and it much longer process for a marriage Visa. It took me 2 years before I got a final interview. Then the original person I went  through the visa process backed out.  I am in the same group as a stable relationship. I am interested if you get through without a visa or a Visitor Visa in a stable relationship from Mexico. Since that seems the only way Brazilian are getting into the US with a Visa.

US citizen here.  typing in Maryland.  I made it back from Salvador last week, no issues at all, although the plane from Sao Paulo to Ft Lauderdale was nearly empty.  They still wont let my girlfriend come with me even though Brazil cases and deaths are a small fraction of what they were 3 months ago.

As of Nov. the US will open to Brazil and other countries. One must be fully vaccinated and a Neg Covid test.
As to going to Mexico, you have to have a US Visa wait 15 days, get a neg test and fly or enter via land.

I go back and forth between SP and Seattle never had an issue. And you are right, the planes have not been full at all
