Working while visa on process

Hi,

I just resigned from work and got offer to another company. I was asked to report to work while my pass is still on process. They told me that technically, it is legal because they can hire me as consultant while waiting for the result of the pass. Is that legal?? And also, they are applying my visa with a different company name as they don't have a quota for Spass. What are the risks? Please help. Thanks.

You CANNOT legally do any work (employed, consultant, or even unpaid) without a valid work visa. Penalties are stiff, so DON'T do it!
Getting a visa as (freelance) consultant is much more difficult than a normal EP (for employment).
Once you have an EP, you can ONLY work for the company it is issued for. You CANNOT work for any other.
Altogether your job offer and the offering company look very dubious. You are well advised to walk away and look for something else!
