SPass rejected once, EP rejected and the appesl also rejected

Hi all,

I am a fresh graduate from the University of Birmingham but the course is conducted in Singapore, which is in SIM. I studied in Singapore for around 5 years already since my Diploma. I have 2 internship experience in Indonesia. I am an Indonesian Chinese.

On August 2018, I was offered a job in a MNC in risk & compliance industry, one reason that I was offered the job is because of my ability to speak Indonesian and I am familiar with Indonesia's risk environment. Hence the role fit strongly to my profile. My company applied for SPass with the salary of $3,300 per month. However, 2 weeks after the application, my Spass was rejected and my company chose not to proceed to appeal. The reason of rejection was; 'This candidate is not eligible for the pass'

Then on October 2018, I was offered another job again, in a MNC and in risk management industry as well. I was offered the role because of my Indonesian background and knowledge as well. The company applied EP for me with the salary of $3,800 per month. However, it was rejected again on November 2018, but my boss said that he really need to hire me to handle matters in Indonesia. The reason of rejection was also "This candidate is not eligible for the pass". Hence, my company decided to appeal with also submitting a letter justifying why the company need to hire me (which is my ability to handle works in Indonesia). Then, the appeal was reject again on December 2018. Now my company said that we are out of option.

After doing some research, i found that it is possible for my company to set an appointment with MOM and discuss about the reason of rejection and appeal directly to it.

While there is also an option to engage with a Visa Agency that has more experience and knowledge to deal with Visa application and appeal.

Hence, I would like to get an enlightenment from this forum, please anyone with the same experience share your thoughts with me. What is my chance now to set up an appointment with MOM and appeal the second time? Or should I engage with a Visa Agency to deal with this matter?  Or is there anything else I can do?

"This candidate is not eligible for the pass" is MoM's death penalty: You cannot and will not get a work pass. Any work pass.
And there is nothing the employer (or a visa agent) can do about it.
The only possibility you have is finding out the reason for this rejection and removing it. You can and should contact MoM and ICA about it (and possibly the police force, in case you ever had contact with them).

Hi beppi,

Thank you for you advice, do you know what is usually the reason behind the statement "This candidate is not eligible for the pass"? Is it like due to crime record?
Because I do not have any record with the ICA or police.
And by contacting the MOM or ICA, can I do it personally or I need my company to contact them?

Then again, I had a friend that got his SPass rejected for the same reason as me, but he got his EP from his second job offer.

There is a large number of possible reasons for such an "adverse record". Only you can contact ICA, the police and other authorities, both you and the employer can contact MoM.

I will try to persuade my HR to set up an appointment with the MOM and I will also contact ICA to check whether I have any adverse record.
