Legal advice - Relationship Property debt from Sweden

Hi

Can relationship property division occurring under the court system of another country include CSN student loan debt that was taken by one party while in a relationship in Sweden? The money of that loan was used by both parties and the family, and both parties are swedish citizens.

Hello, welcome to the forum!

It depends on how the court system of this particular country would see the matter. Although a CSN student loan is a personal debt, it counts as a normal bank loan in the eyes of Swedish law concerning such a matter.

Thats great Finnbo i appreciate the answer.

Do you know if there are any cases that i can read up on? Even something within sweden where CSN debt was split after a relationship property settlement in the courts?

Dunn, I never said it can be split, so first of all let me clarify what I meant. As we both know main rule is, the one who takes a personal loan will always be responsible for the debt, however let say A and B are a married (or registered sambo) couple and A had a CSN loan while B had no incomes at all during a certain period of their relationship, so in that case it is obvious that B was supported by A`s CSN loan during that period, but for that matter the loan cannot be split in retrospectively in a case of divorce later, yet  there is a possibility to count it in the total calculation of the estate division.
